Harmonizing Practices Related to the Enforcement Procedure

On February 20, 2018, in Kragujevac, under the auspices of the Supreme Court of Cassation, the USAID Rule of Law Project joined forces with the EU Judicial Efficiency Project in delivering a roundtable on the subject of the Supreme Court of Cassation case law related to the application of the Law on Enforcement and Security. This started a series of four roundtables in total which enabled open dialogue between the judiciary and the public enforcement officers on practical issues related to the implementation of the Law on Enforcement and Securities since it came into force in July 2016.

The remaining three roundtables took place during March in Niš (01.03.), Belgrade (09.03.) and Novi Sad (15.03.). The common thread for all four events was considerable interest expressed by all stakeholders, both judges of basic, higher, and commercial courts, and public enforcement officers, in clarifying common issues important for improving the enforcement procedure. Gathering over 250 participants, events like these are an excellent example of donor projects coordinating in extending support to institutions for exchanging views and improving practices.

Assistant Minister for judiciary in the Ministry of Justice, Jelena Deretić, attended the event in Belgrade and used it as an opportunity to announce the upcoming work on drafting amendments to the Law on Enforcement. The working group to be appointed by the Ministry will take into consideration the problems and solutions identified through the roundtables, as well as formulated by the Supreme Court of Cassation, the Chamber of Public Enforcement Officers, the Chamber of Commerce, the National Bank of Serbia and other institutions, utilizing them as building blocks for improving the legislative framework. The USAID Rule of Law Project will provide expert and logistical assistance to this process.
