Training – Law on the Right to Trial Within Reasonable Time

One-day workshops which were held in parallel today in Novi Sad and Kragujevac mark the beginning of a series of training sessions on the topic of the right to trial within reasonable timeframe. In cooperation with the Judicial Academy and the Council of Europe, the USAID Rule of Law Project is implementing a joint training for judges and court presidents of basic and commercial courts, as well as the representatives of the State Attorney’s Office in order to present the case law of both the European Court of Human Rights and Serbian courts in this matter and allow for a smooth application of the Guidelines for improving and promoting the out-of-court settlement procedure in cases of protecting the right to trial within reasonable time.

This training and the Settlement Guidelines are intended to mitigate the problems caused by a significant increase in the number of objections to speed up court procedures in 2018, as well as a marked rise in the number of claims seeking damages for breaching the right to trial within reasonable time. During only two months of its application, the Guidelines have already shown good results – there have been 197 requests for out-of-court settlement, 134 out of which have been sent for signature, while 13 have been concluded. Before the Guidelines have been adopted, in the first seven months of 2018, only 3 out-of-court settlement agreements have been concluded.
